  efinition of bill of exchange
  A bill of exchange is an unconditional order in writing, addressed 
by
  person to another, signed by the person giving it, 
requiring the
  on to whom it is addressed to pay on demand or at a 
fixed or
  rminable future time a sum certain in money to, or to the order
of, a
  ified person or to bearer.
  An instrument which does not comply with these conditions, or 
which
  rs any act to be done in addition to the payment of money, is 
not a
  of exchange.
  An order to pay out of a particular fund is not
  nditional within the meaning of this section; but an unqualified
order
  ay, coupled with--
  an indication of a particular fund out of which the drawee 
is to
  burse himself or a particular account to be debited with the

bill, is

  A bill is not invalid by reason--

  An inland bill is a bill which is or on the face of it purports
to be-
  
  both drawn and payable within the Colony; or
  drawn within the Colony, upon some person resident therein.
  Any other bill is a foreign bill.
  Unless the contrary appears on the face of the bill, the holder 
may

  A bill may be drawn payable to, or to the order of, the drawer;
or it
  be drawn payable to, or to the order of, the drawee.
  Where, in a bill, drawer and drawee are the same person, or where 
the
  ee is a fictitious person or a person not having capacity to
contract,
  holder may treat the instrument, at his option, either as a 
bill of

  A bill may be addressed to two or more drawees,

  Where a bill is not payable to bearer, the payee must be 
named or
  rwise indicated therein with reasonable certainty.
  A bill may be made payable to two or more payees jointly, or it
may be
  payable in the alternative to one of two or one or some of 
several
  es. A bill may also be made payable to the bolder of an office
for the
  being.
  Where the payee is a fictitious or non-existing person, the bill 
may
  reated as payable to bearer.

  Where a bill contains words prohibiting transfer, or 
indicating an
  ntion that it should not be transferable, it is valid as between 
the
  ies thereto, but is not negotiable.
  A negotiable bill may be payable either to order or to bearer.
  A bill is payable to bearer which is expressed to be so payable,
or on
  h the only or last indorsement is an indorsement in blank.
  A bill is payable to order which is expressed to be so payable, 
or
  h is expressed to be payable to a particular person, and 
does not
  ain words prohibiting transfer or indicating an intention 
that it
  ld not be transferable.
  Where a bill, either originally or by
  rsement, is expressed to be payable to the order of a 
specified
  on, and not to him or his order, it is nevertheless payable to
him or
  order at his option.

  The sum payable by a bill is a sum certain within the meaning of 
this
  nance, although it is required to be paid--
  with interest;
  by stated instalments;
  by stated instalments, with a provision that, upon default in 
payment
  ny instalment, the whole shall become due;
  according to an indicated rate of exchange or according to a rate 
of
  ange to be ascertained as directed by the bill.
  Where the sum payable is expressed in words and also in figures, 
and
  e is a discrepancy between the two, the sum denoted by the words 
is
  amount payable.
  Where a bill is expressed to be payable with
  rest, unless the instrument otherwise provides, interest runs
from the
  of the bill, and, if the bill is undated, from the issue thereof.

  Bill payable on demand
  A bill is payable on demand--
  which is expressed to be payable on demand, or at sight, 
or on
  entation; or
  in which no time for payment is expressed.
  Where a bill is accepted or indorsed when it is overdue, it shall, 
as
  rds the acceptor who so accepts or any indorser who so indorses
it, be
  ed a bill payable on demand.

  Bill payable at future time
  A bill is payable at a determinable future time within the meaning 
of
  Ordinance which is expressed to be payable--
  at a fixed period after date or sight;
  on or at a fixed period after the occurrence of a specified 
event
  h is certain to happen, though the time of happening may be
uncertain.
  An instrument expressed to be payable on a contingency is not a 
bill,
  the happening of the event does not cure the defect.

  Omission of date in bill payable after date
  e a bill expressed to be payable at a fixed period after 
date is
  ed undated, or where the acceptance of a bill payable at a 
fixed
  od after sight is undated, any holder may insert therein the true
date
  ssue or acceptance, and the bill shall be payable 
accordingly:

  where the holder in good faith and by mistake inserts a wrong 
date;
  
  n every case where a wrong date is inserted, if the bill
  equently comes into the hands of a holder in due course, the 
bill
  l not be avoided thereby, but shall operate and be payable as if 
the

  Ante-dating and post-dating
  Where a bill or an acceptance or any indorsement on a bill is 
dated,
  date shall, unless the contrary is proved, be deemed to be the 
true
  of the drawing, acceptance, or indorsement, as the case may be.
  A bill is not invalid by reason only that it is ante-dated or 
post-
  d, or that it bears date on a Sunday or any other general holiday.

  Computation of time of payment
  e a bill is not payable on demand, the day on which it falls due 
is
  rmined as follows--
  the bill is due and payable in all cases on the last day of the 
time
  ayment as fixed by the bill or, if that is a general holiday, on 
the

  where a bill is payable at a fixed period after date, after sight, 
or
  r the happening of a specified event, the time of 
payment is
  rmined by excluding the day from which the time is to begin to
run and
  ncluding the day of payment;
  where a bill is payable at a fixed
  od after sight, the time begins to run form the date of the
acceptance

  "month" in a bill means calendar month.

  Referee in case of need
  drawer of a bill and any indorser may insert therein the name 
of a
  on to whom the holder may resort in case of need, that is to say, 
in
  the bill is dishonoured by non-acceptance or non-payment. Such
person
  alled the referee in case of need. It is in the option of the 
holder
  esort to the referee in case of need or not, as he may think fit.

  Optional stipulations by drawer or indorser
  drawer of a bill and any indorser may insert therein an 
express
  ulation--
  negativing or limiting his own liability to the holder;
  waiving, as regards himself, some or all of the holder's duties.

  Definition and requisites of acceptance
  The acceptance of a bill is the signification by the drawee of 
his
  nt to the order of the drawer.
  An acceptance is invalid unless it complies with the 
following
  itions, namely--
  it must be written on the bill and be signed by
  drawee. The mere signature of the drawee, without additional
words, is
  icient;
  it must not express that the drawee will perform his promise by 
any
  r means than the payment of money.

  Time for acceptance
  A bill may be accepted--
  before it has been signed by the drawer, or while 
otherwise
  mplete;
  when it is overdue, or after it has been dishonoured by a
  ious refusal to accept or by non-payment.
  When a bill payable after sight is dishonoured by non-acceptance, 
and
  drawee subsequently accepts it, the holder, in the absence 
of any
  erent agreement, is entitled to have the bill accepted as of the 
date
  irst presentment of the drawee for acceptance.

  General and qualified acceptance
  An acceptance is either (a) general; or (b) qualified.
  A general acceptance assents without qualification to the order
of the
  er. A qualified acceptance in express terms varies the effect of 
the
  as drawn.
  In particular, an acceptance is qualified which is--
  conditional, that is to say, which makes payment by the 
acceptor
  ndent on the fulfilment of a condition therein stated,
  partial, that is to say, an acceptance to pay part only of the 
amount
  which the bill is drawn;
  local, that is to say, an acceptance to pay only at a 
particular
  ified place; an acceptance to pay at a particular place is a 
general
  ptance, unless it expressly states that the bill is to be paid 
there
  and not elsewhere;
  qualified as to time;
  the acceptance of some one or more of the drawees, but not of all.

  Inchoate instruments
  Where a simple signature on a blank paper is delivered by the 
signer
  rder that it may be converted into a bill, it operates as a 
prima
  e authority to fill it up as a complete bill for any amount, using
the
  ature for that of the drawer, or the acceptor, or an indorser;
and, in
  manner, when a bill is wanting in any material particular, the
person
  ossession of it has a prima facie authority to fill up the omission
in
  way he thinks fit. (Amended 31 of 1981 s. 65)
  In order that any such instrument, when completed, may be 
enforceable
  nst any person who became a party thereto prior to its completion, 
it
  be filled up within a reasonable time and strictly in accordance
with
  authority given. Reasonable time for this purpose is a 
question of
  : Provided that if any such instrument after completion is 
negotiated
  holder in due course, it shall be valid and effectual 
for all
  oses in his hands, and he may enforce it as if it had been filled 
up
  in a reasonable time and strictly in accordance with the 
authority

现将《滁州市行政执法案卷评查规定(试行)》印发给你们,请结合实际,认真贯彻执行。

滁州市行政执法案卷评查规定(试行)



第一章 总  则



第一条 为加强行政执法监督,规范行政执法行为,提高行政执法水平,推进依法行政,根据有关法律、法规和国务院《全面推进依法行政实施纲要》等规定,结合我市实际,制定本规定。

第二条 本规定所称行政执法案卷,是指行政执法部门在行政处罚、行政许可、行政确认、行政裁决、行政征收、行政强制、行政赔偿、行政补偿等执法活动中形成的法律文书、证据和有关材料等经过依法归档的案卷。

行政执法案卷评查是指上一级人民政府对下一级人民政府、政府对所属行政执法部门、上一级行政执法部门对下一级行政执法部门、行政执法部门对所属行政执法机构在行政执法活动中形成的业已结案的行政执法案卷进行检查、评议并实施监督的活动。

第三条 本规定所称行政执法部门是指具有行政执法权的行政机关、法律法规授权执法的组织、依法接受委托执法的组织。

第四条 行政执法案卷评查实施机关应当确定案卷评查标准。市及各县、市、区人民政府及其部门制定的案卷评查标准,不得与上级机关制定的标准相抵触。各级政府制定的案卷评查标准与上级政府部门制定的评查标准不一致的,以上级政府部门制定的评查标准为准。

第五条 行政执法案卷评查应当依法、公开、公平、公正开展,坚持实体规范与程序规范相结合;内容规范与形式规范相结合;纠正违法和激励先进相结合;评查结果与落实执法责任相结合;层级监督与行政执法部门内部自我监督相结合的工作原则。

第六条 行政执法案卷评查工作应当定期开展,每年不少于1次。

第七条 县级以上人民政府法制机构具体负责组织、协调、指导、监督检查行政执法案卷评查工作。

行政执法部门法制机构具体负责对本部门行政执法机构的行政执法案卷进行评查。市级行政执法部门可按系统组织开展行政执法案卷评查工作,并对本系统下级行政执法部门开展的行政执法案卷评查工作进行指导和监督检查。

第八条 组织行政执法案卷评查应当符合法律、法规、规章规定,采取措施保证被评查的行政执法案卷整洁和完好无损。



第二章 行政执法案卷评查工作的组织



第九条 各县、市、区人民政府和各行政执法部门应当根据本行政区域、本系统、本部门行政执法工作实际,建立和完善行政执法案卷评查工作规范,组织开展行政执法案卷评查工作。

第十条 行政执法案卷评查采取全面评查或者按系统评查的方式,评查机关可以直接评查,可以组织相互评查,必要时,也可以委托第三方评查。

第十一条 行政执法案卷评查可以聘请专家、学者、具有法制工作实践经验的人员、政府特邀行政执法监督员等有关专业人员参加评查。

第十二条 组织实施行政执法案卷评查,按照下列程序进行:

(一)成立行政执法案卷评查组织,制订行政执法案卷评查方案,下发开展行政执法案卷评查的通知,部署工作,提出要求,明确行政执法案卷评查的范围、内容、方法、步骤、时限和要求等;

(二)采取随机抽取案卷办法评查的,要求被评查行政执法部门按规定提供或者报送一定期限内的行政执法案卷目录,由行政执法案卷评查组织根据目录按比例随机抽取行政执法案卷;

(三)采取选送案卷办法评查的,要求被评查行政执法部门按要求提供或者报送自选行政执法案卷;

(四)评查行政执法案卷可以到被评查行政执法部门现场评查,也可以在行政执法案卷评查组织确定的地点进行;

(五)行政执法案卷评查人员根据行政执法案卷评查标准审查行政执法案卷并制作或者填写统一格式的行政执法案卷评查表;

(六)行政执法案卷评查表应当注明所评行政执法案卷名称、文号、存在的问题、判定的依据、初评意见和建议等,并由行政执法案卷评查组成员签字;

(七)行政执法案卷评查实行集体评议制,行政执法案卷评查组织应当集体讨论案卷初评结果和主要问题,确定所评行政执法案卷评查结果;

(八)对可能影响公正评查的,行政执法案卷评查组织应当要求有关评查人员回避;

(九)确因工作需要,对涉及国家秘密、商业秘密或者个人隐私的行政执法案卷进行评查时,行政执法案卷评查组织应当由专人保管、专人评查,防止毁损、遗失、泄密;

(十)行政执法案卷评查组织书面报告行政执法案卷评查情况和结果;

(十一)行政执法案卷评查结束后,行政执法案卷评查组织应当通知被评查行政执法部门取回行政执法案卷。



第三章 行政执法案卷评查结果的应用



第十三条 行政执法案卷评查结果应当作为行政执法评议考核、依法行政考核等相关考核的重要依据之一。

第十四条 行政执法部门应当结合行政执法案卷评查工作,建立健全纠错机制,研究制定改进行政执法工作的整改措施。

第十五条 对不按照工作部署开展行政执法案卷评查的行政执法部门予以通报批评,限期改正。

第十六条 在行政执法案卷评查中发现行政执法案卷有下列情形之一的,案卷评查机关依法确定该项行政行为违法或依照法定程序撤销该行政行为,并依法追究相关人员的行政执法责任,造成损害的,按照《中华人民共和国国家赔偿法》的有关规定予以赔偿。

(一)行政执法主体不合法的;

(二)行政执法行为程序不符合法定要求,影响认定事实和适用法律的;

(三)作出的行政执法行为无法定依据的;

(四)作出的行政执法决定所依据的事实没有证据证明的;

(五)其他不合法的行政行为。

第十七条 在行政执法案卷评查中发现存在第十六条所列情形之外的其他不符合行政执法案卷评查标准的问题,上级行政机关应当督促被评查行政执法部门改进行政执法工作。

第十八条 行政执法部门接到行政执法督查通知书后,应当根据行政执法督查通知书要求,采取措施进行整改,并按要求反馈整改情况。

第十九条 行政机关应当对在行政执法案卷评查中案卷优秀率、合格率较高的被评查行政执法部门予以通报表彰,对案卷合格率较低的予以通报批评。

第二十条 各行政执法部门案卷评查结束后应当及时将评查情况报上一级行政机关,并抄送同级政府法制机构。



第四章 附  则



第二十一条 各县、市、区人民政府和各行政执法部门可以根据本规定,结合本地本部门实际制订实施细则。

第二十二条 本规定自印发之日起施行。

佳木斯市城市户外广告空间使用权经营管理办法



第一条 为加强户外广告设置管理工作,规范城市户外广告空间使用权经营行为,有效配置户外广告空间资源,根据《中华人民共和国城镇国有土地使用出让和转让暂行条例》、国法函〔1998〕134号《关于在黑龙江省佳木斯市开展城市管理综合执法试点工作的复函》等有关规定,结合我市实际,制定本办法。

第二条 城市户外广告空间属城市公共资源的组成部分,是特殊形态的国有资产,属经营性使用的,必须实行有偿原则,依法采取协议、招标、拍卖方式出让。

第三条 本办法所称城市户外广告空间,是指在本市城区道路两侧、公共绿地、广场等地段以及桥梁、构筑物和建筑物等可用于建设户外广告媒体的有效空间。

第四条 市城市管理行政执法局负责市区户外广告空间使用权经营管理工作。各相关行政执法部门要按照各自法定职责,各司其职,协调配合,共同管理好城市户外广告使用权经营管理工作。

第五条 城市户外广告空间,依法适于协议出让的,按《合同法》规定出让;适于招标出让的,按《招投标法》规定出让;适于拍卖出让的,按《拍卖法》规定拍卖出让,但提倡依法采取拍卖方式出让。

第六条 没有设立地上权或地上权人是国家机关、人民团体、事业单位的,其广告空间拍卖由市城市管理行政执法局直接办理;地上权人为企业法人或公民个人,且广告空间处在商业繁华地带、主要景区以及市区主要街路两侧的,由市城市管理行政执法局商其签订统一拍卖委托合同,实行统一拍卖。

第七条 市城市管理行政执法局委托具有招标拍卖资质的部门组织实施全市户外广告空间使用权拍卖工作。

第八条 户外广告空间使用权拍卖(以下简称广告空间拍卖),应当遵守法律、法规的规定,本着公开、公平、公正、诚实信用的原则进行。

第九条 所称拍卖人是指依法设立的从事拍卖活动的企业法人;所称委托人是指佳木斯市城市管理行政执法局;所称竞拍卖人是指集中参加竞价拍卖的组织和个人;所称买受人是指最终竞以最高价竞得经营权的组织和个人。

第十条 广告空间拍卖,一律采用底价拍卖,成交的广告空间使用年限根据空间的地理位置,媒体类型的不同分别确定为3年、5年,到达使用年限后,市政府收回广告空间并重新组织出让。拍卖底价由委托人指定的具有评估资质的评估机构,根据广告位置的地理环境条件等进行测算,确定拍卖底价。

第十一条 委托人依据户外广告专项规划和有关规定编制拍卖文件。拍卖文件应当包括拍卖公告、拍卖空间位置、竞买申请书文本、拍卖成交确认书文本、拍卖合同书。

第十二条 拍卖人应当于拍卖前至少7日,在市以上主要报刊或媒体发布拍卖公告,并在公告规定的时间、地点进行拍卖。

第十三条 委托人应当按照拍卖文件的规定对竞买申请人的资格进行审查,并对符合条件的进行登记编号。

第十四条 竞买人必须是具有户外广告发布资质的单位或个人。

第十五条 竞得人必须按照户外广告空间拍卖合同约定的位置、时间、施工图纸进行建设。施工不得超过委托人规定的建设时间,不得擅自改变规划条件。

第十六条 竞买人可以对拍卖位置进行勘察,如有异议,拍卖人应予以解释。

第十七条 买受人应当在签订《拍卖成交确认书》后,按时限缴纳全部拍卖金。

第十八条 建设、规划等部门应当依据签订的广告空间使用权拍卖合同,为竞得人办理有关手续。

第十九条 竞得人有下列行为之一的,取消竞得资格,所交付的佣金不予退还。

(一)提供虚假文件、隐瞒事实的。

(二)以非法手段竞得的。

(三)未缴纳全部拍卖金的。

第二十条 竞得人未按规定签订《拍卖合同书》和缴纳拍卖金的,应当支付拍卖佣金。

第二十一条 拍卖人未按合同交付广告空间位置使用权的,应当返还所缴纳价款,买受人有权解除合同。

第二十二条 协议、招标、拍卖出让广告空间所获出让金,没设立地上权或地上权人为国家机关、人民团体事业单位的,全部上缴市财政;地上权为企业法人、公民个人的,出让金归地上权人所有,但要向财政上交所获出让金额相当比例的广告空间统一出让经营成本费用。具体办法由城市管理行政执法局、市财政局、物价局制定,地上权人不明确的,出让金由市财政局代管。

第二十三条 从事广告空间出让工作部门有关工作人员滥用职权、徇私舞弊的,由其所在单位或者上级行政主管部门给予行政处分;触犯刑律的,移送司法机关处理。

第二十四条 本办法自公布之日起施行,由市城市管理行政执法局负责解释。



佳木斯市建筑材料建筑垃圾工程渣土运输管理暂行规定



第一章 总 则



第一条 为加强我市建筑材料、建筑垃圾、工程渣土运输管理,提高城市市容环境卫生质量,根据国务院《城市市容和环境卫生管理条例》、《城市道路管理条例》和建设部《城市建筑垃圾管理规定》、《关于有效控制城市扬尘污染的通知》的有关法规,结合我市实际,制定本规定。

第二条 凡在我市城市建成区(东起沈括街,西至沿江村大门、南起达贤路、水利三处、北至沿江路)区域内从事建筑材料、建筑垃圾、工程渣土运输车辆的单位和个人,必须遵守本规定(不含外埠临时过境车辆)。

第三条 本规定所称建筑材料是指砖瓦、沙石、水泥、钢材、木材、空心板、沥青、油毡、灰条等;所称建筑垃圾工程渣土是指建设、施工单位或个人对各类建筑物、构筑物、管网等进行建设、铺设或拆除、修缮过程中所产生的渣土、弃土、弃料、余泥及其它废弃物(含供热原煤、型煤、灰渣运输);所称的散装建材、液体是指运输散装水泥、混凝土搅拌、液体罐车;所称垃圾管理是指对建筑材料、建筑垃圾、工程渣土的收集、堆放、运输、中转、回填、受纳、处理的管理;所称建筑垃圾工程渣土受纳场是指按城市规划、建设、管理需要设置的建筑垃圾堆放、处置的场地。

第四条 建设材料、建筑垃圾、工程渣土、运输管理工作实行全面规划、统一管理、分级负责、职能部门监督与社会监督相结合的原则。

第五条 市城市管理行政执法局是我市建筑材料、建筑垃圾、工程渣土、运输管理的行政主管机关,负责组织实施本规定,其所属城市管理行政执法局负责具体管理工作。

各级规划、公安、建设、交通、市政、房产、国土、电信、环保等管理部门应各司其职,密切配合市城市管理行政执法部门实施本规定。

第六条 任何单位和个人都有维护城市市容环境卫生的义务,并有权对违反本规定的行为进行举报。所有从事建筑材料运输车辆的单位和个人,必须按本规定承担收集、运输过程中造成污染治理和处置的责任;不具备处置能力的,可委托垃圾管理机构有偿处置。

第七条 各级城市管理行政执法部门应将建筑材料、建筑垃圾、工程渣土运输纳入对建筑工程及施工单位的考核中来,严查违规车辆。各施工单位按规定要求,严格管理各类运输车辆进入施工现场,运输车辆业主要主动接受监督、检查、管理。对在管理工作中成绩显著的单位和个人予以表彰和奖励。



第二章 处置管理



第八条 产生建筑垃圾、工程渣土的单位或个人,必须在工程开工前15日内,持《建设工程规划许可证》或《拆迁许可证》等有关证照到市城市管理行政执法部门申报工程规模、产生建筑垃圾、工程渣土的处置计划,签订《市容环境卫生责任书》,办理建筑垃圾、工程渣土定点清运手续。

第九条 施工单位应对施工现场出入口的环境卫生落实专人清扫保洁,所产生的建筑垃圾、工程渣土应委托具有从事建筑垃圾、工程渣土《拍卖成交确认书》和拍卖、成交确认标志标识的车辆及时收集、清运。不准将建筑垃圾、工程渣土倾倒在生活垃圾桶(箱、池)内和绿化带、河道、街巷(空地)等处。

第十条 凡需要建筑垃圾、工程渣土回填的,应到市城市管理行政执法主管部门申报所需渣土的数量、种类,回填地点、时间,由其统一安排调剂。

第十一条 工程竣工后,施工单位在15日内(占道施工的在5日内)将建筑垃圾、工程渣土处置干净,并报当地城市管理行政执法主管部门验收。

第十二条 个人装修或维修房屋等产生的建筑垃圾,经市容环境卫生管理部门和物业管理部门同意后,可将建筑垃圾堆放到指定的临时堆放点,并按规定交纳建筑垃圾处置费。

第十三条 任何单位和个人不得任意占用道路堆放建筑垃圾、工程渣土;确因施工需要临时占用道路的,必须按批准的临时占道范围、时间,对建筑垃圾实行封闭式堆放。

第十四条 凡将建筑垃圾、工程渣土运入市容环境卫生管理部门设置的建筑垃圾受纳场消纳、处理的,应按规定交纳处置费。

第十五条 运输建筑材料、建筑垃圾、工程渣土、散装建材、液体运输的车辆必须遵守下列规定:

(一)应当办理交通运输许可或临时营业手续,并通过“公正、公平、公开”的阳光拍卖,获得从事建筑材料、建筑垃圾、工程渣土的运输《拍卖成交确认书》及拍卖成交标志标识。

(二)不准承运未经市城市市容环境卫生行政主管部门核准处置的建筑垃圾。

(三)具有运输经营拍卖成交标志标识的运输车辆,车体、车箱统一喷为桔黄色,统一编号,运输过程中应装载适量、密闭包扎,保持车容整洁,严禁撒漏污染道路,影响市容环境卫生。

(四)建筑垃圾、工程渣土必须按指定路线运往指定的受纳场倾倒。进场后应服从场地管理人员的指挥,按要求倾卸建筑垃圾、工程渣土,并取得回执以备查验。

(五)禁止在城市建成区内擅自倾倒建筑垃圾、工程渣土。

第十六条 建筑垃圾管理的收费项目及其标准按审批权限批准后实施。所收经费用于建筑垃圾管理工作和城市基础设施建设,市容环境卫生事业。



第三章 罚 则



第十七条 违反本规定的单位和个人,由市城市管理行政执法部门责令其纠正违法行为,采取补救措施,并依据国家、省有关法规予以处罚:

(一)违反本规定第十一条的,责令限期清除;逾期未清除的,视情节处以200元至1000元罚款。

(二)违反本规定第十二条的,除承担建筑垃圾渣土处置费用外,处以个人4至20元罚款、单位500元至1000元罚款。

(三)违反本规定第十五条之(一)项的,由市城市管理行政执法部门责令停止违法经营,补办道路运输许可或临时营业手续、《拍卖成交确认书》、拍卖成交标志标识,拒不接受处罚的,可暂扣运输工具。

(四)违反本规定第十五条之(三)项的,除责令立即改正、采取补救措施,每车处以40元至200元罚款,并按因遗撒而污染、损坏路面的实际面积收缴路面清扫、维修有偿费用。

第十八条 违反本规定,对市容环境卫生造成污染损害的,责令限期清除;逾期未清除的,市容环境卫生管理部门或其委托单位可代为清除,有关费用由当事人承担。

第十九条 当事人对处罚决定不服的,可依法申请行政复议或提起行政诉讼。复议或诉讼期间不停止处罚决定的执行。

第二十条 市城市管理行政执法部门工作人员应依法管理,秉公执法,自觉接受人民群众监督。滥用职权、徇私舞弊、玩忽职守的,由其所在单位或上级主管机关给予行政处分;构成犯罪的,依法追究刑事责任。

第二十一条 市城市管理行政执法部门工作人员依法执行公务受法律保护。拒绝、阻碍其执行公务的,由公安机关依照《中华人民共和国治安管理处罚条例》予以处罚;构成犯罪的,依法追究刑事责任。



第四章 附 则

第二十二条 本规定由佳木斯市城市管理行政执法局负责解释。

第二十三条 本规定自公布之日起施行。
















佳木斯市城市公共资源经营权协议招标拍卖管理暂行规定



第一条 为加强本市公共资源经营权管理,根据国法函〔1998〕134号《关于在黑龙江省佳木斯市开展城市管理综合执法试点工作的复函》等有关规定,结合我市实际,制定本规定。

第二条 城市公共资源是特殊形态的国有资产(包括:从事运输渣土、煤渣、沙子、垃圾、砖石、水泥、钢材、空心板、沥青、油毡、液体等材料的车辆;机动车停车泊位;汽车美容、刷车站点;营运三轮车、畜力车;主要街路广场展示;占道市场摊位;环卫设施购置配备;临街建筑立面改造;环卫民营化;各类广告设置等),凡属经营性使用的,必须遵循有偿原则。城市公共资源有偿使用,实行目录管理制度,每年在市级新闻媒体上公布一次,凡列入目录的城市公共资源,都可以有偿出让。

第三条 城市公共资源的经营管理由市城市管理行政执法部门负责,各行政执法部门按法定职责各司其职,协调配合,共同管理好城市公共资源的开发和利用。

第四条 城市公共资源依法宜协议出让的,可以按《合同法》规定出让,宜招标出让的,可以按《招投标法》出让,宜拍卖出让的,可以按《拍卖法》出让。

第五条 市城市管理行政执法局可委托具有招标拍卖资质的部门组织实施城市公共资源经营权的招标、拍卖和经营工作,工商、建设、运管、交警等部门应当依据签订城管部门确认的城市公共资源项目经营权协议书、投标确认书或拍卖合同,为受让人办理有关手续。

本办法所称拍卖人是指依法设立的从事拍卖活动的企业法人;所称委托人是指佳木斯市城市管理行政执法局;所称竞拍卖人是指集中参加竞价拍卖的组织和个人;所称买受人是指最终竞以最高价竞得经营权的组织和个人。

第六条 城市公共资源经营权拍卖出让,应当遵守法律、法规的规定,本着公开、公平、公正、诚实信用的原则进行。城市公共资源经营权拍卖一律采用参考价拍卖,成交的城市公共资源使用年限根据城区改造规划的实际情况,分别确定为三年和五年。协议、招标、拍卖经营权期满后,重新组织规划协议、招标、拍卖出让。协议、招标、拍卖底价由委托人指定的具有评估资质的评估机构,根据城市公共资源市场条件等进行测算确定。

第七条 委托人依据城市建设专项规划和有关规定编制拍卖文件。拍卖文件应当包括拍卖公告、拍卖城市资源量、竞买申请书文本、拍卖成交确认书文本、拍卖合同书。

第八条 拍卖人应当于拍卖前至少7日,在市以上主要报刊或媒体发布拍卖公告,并在公告规定的时间、地点进行拍卖。

第十一条 竞买人可以对拍卖的城市公共资源市场进行调查,如有异议,拍卖人应予以解释。

第十二条 买受人应当在签订《拍卖成交确认书》后,按时限缴纳全部拍卖金。

第十三条 城市公共资源协议、招标、拍卖出让的具体条件、程序、时限、收费等管理办法,由市城市管理行政部门根据实际情况制定并向社会公布。

第十四条 城市公共资源的转让通过拍卖方式获得的竞得人有下列行为之一的取消其竞得资格,所交付的佣金不予退还。

(一)提供虚拟文件、隐瞒事实的;

(二)以非法手段竞得的;

(三)未缴纳全部拍卖金的。

第十五条 买受人有下列行为之一的,取消经营资格,

所交付的拍卖金不予退还。

(一)涂改、修改、倒卖伪造《拍卖成交确认书》的;

(二)拍卖后的车辆牌号一牌多用的;

(三)不遵守规定要求的;

(四)不履行《拍卖成交确认书》有关内容的。

第十六条 依据国家法律、法规、规章等相关规定,对于

没有取得城市公共资源经营权的法人、公民擅自从事经营活动,有关行政执法部门要依据有关法律、法规予以处罚。

第十七条 城市公共资源协议、招标、拍卖出让所得资金全部上缴市财政,用于城市设施建设和管理。市城市管理行政执法部门的收费和罚金,施行罚缴分离、收支两条线,全部上缴国库。

第十八条 当事人对市城市管理行政执法局的处罚不服的,可以依法申请行政复议或提起行政诉讼。

第十九条 本规定自公布之日起施行,由市城市管理行政执法局负责解释。
